These Terms of Use govern your access to and use of iPOLOGIE, including our website, apps and related services (the "Service"). Please read them carefully.
1. Accepting these terms
By creating an account, purchasing credits, or otherwise using the Service, you agree to these Terms and to our Privacy policy. If you do not agree, do not use the Service.
2. Eligibility
You must be at least 18 years old, or the age of majority where you live, to use the Service. By using it, you confirm that you meet this requirement and that you can enter into a binding agreement.
3. Your account
You are responsible for the information you give us, for keeping your sign-in details secure, and for everything that happens under your account. Tell us right away at help@ipologie.app if you believe your account has been used without your permission.
4. What iPOLOGIE is, and is not
iPOLOGIE helps you prepare and deliver a personal iPOLOGIE by video, voice, or text. It is a communication tool. It is not legal advice, therapy, counselling, mediation, or a substitute for professional help. We do not guarantee how a recipient will respond, or any particular outcome.
5. Acceptable use
You agree not to use the Service to contact anyone who has asked you not to contact them, anyone protected by a restraining, protective, or no-contact order involving you, or in any way that could amount to harassment, stalking, threats, intimidation, or abuse. You also agree not to send unlawful, hateful, sexually explicit, or misleading content, impersonate anyone, admit to or describe crimes in a way that endangers others, or interfere with the Service or its security. We may remove content and suspend or close accounts that break these rules, and we may cooperate with law enforcement where required.
6. Your content
You keep ownership of the messages, recordings, and other content you create ("Your Content"). You give us a limited, worldwide, non-exclusive licence to host, process, store, and deliver Your Content solely to operate and improve the Service and to deliver it to the recipients you choose. You are responsible for Your Content and confirm you have the right to share it.
7. Recipients and responses
When you send an iPOLOGIE, the recipient can view it and may choose to respond. A response is the personal statement of the person who sends it. The Service is not a confidential, privileged, or legally protected space, and anything sent through it may be kept or shared by the person who receives it.
8. AI-assisted writing
Some features use artificial intelligence to suggest wording. Suggestions may be inaccurate, incomplete, or not right for your situation. You are responsible for reviewing and editing anything before you send it.
9. Purchases and credits
Some features require credits that you buy in advance. Prices are shown before you pay, and payments are handled by our payment provider. Credits have no cash value, cannot be transferred except through our gifting feature, and are non-refundable except where the law requires otherwise or where we say so at the time of purchase.
10. Our service
The Service, including its software, design, text, and branding, belongs to iPOLOGIE and its licensors. We give you a personal, non-transferable right to use it in line with these Terms. You may not copy, modify, resell, or reverse engineer it except where the law allows.
11. Ending your use
You can stop using the Service and delete your account at any time from your profile. We may suspend or end your access if you break these Terms, if required by law, or to protect other people or the Service. Sections that by their nature should survive termination will continue to apply.
12. Disclaimers
The Service is provided "as is" and "as available". To the fullest extent the law allows, we make no warranties of any kind, whether express or implied, including that the Service will be uninterrupted, error-free, or that messages will be delivered or received.
13. Limitation of liability
To the fullest extent the law allows, iPOLOGIE will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of data, reputation, or relationships, arising from your use of the Service. Our total liability for any claim is limited to the amount you paid us in the 12 months before the claim. Nothing in these Terms limits liability that cannot be limited by law.
14. Indemnity
You agree to defend and hold iPOLOGIE harmless from claims, losses, and costs arising from Your Content, your use of the Service, or your breach of these Terms.
15. Changes to these terms
We may update these Terms from time to time. If a change is significant, we will let you know in the app or by email before it takes effect. Continuing to use the Service after a change means you accept the updated Terms.
16. Governing law
These Terms are governed by the laws of the place where iPOLOGIE is established, without regard to conflict-of-law rules. If you are a consumer, you keep any protections the laws of your country of residence give you.
